Understanding BABA Requirements
According to the US Department of Labor, BABA stipulates that all manufactured products used in federally funded projects must be produced in the U.S. Specifically, the manufacturing process must occur in the United States. The cost of the components of the manufactured product that are mined or manufactured in the U.S. must exceed 55 percent of the total cost of all components.
Additionally, the White House clarifies that for construction materials to comply, all manufacturing processes for the construction material must occur within the U.S.A. These requirements are part of the Infrastructure Investment & Jobs Act (IIJA). This act is also referred to as the Bipartisan Infrastructure Law (BIL) – under Title IX, Subtitle A, Part I – Buy America Sourcing Requirements.
